SURVEY FOR DATA CONTROLLERS REGARDING PERSONAL DATA PROTECTION AWARENESS AND UNDERSTANDING OF THE OBLIGATIONS OF THE PERSONAL DATA PROTECTION LAW (“Official Gazette of the Republic of North Macedonia” no. 42/20)
*The survey is conducted as part of the activities of the twinning project “Support in the implementation of the modernized legal framework for the protection of personal data in North Macedonia”, financed by the European Union.
The Personal Data Protection Act is here, are you ready?
Dear Data Controllers,
we invite you to fill out the survey regarding the awareness of personal data protection and the understanding of the obligations of the LAW ON THE PROTECTION OF PERSONAL DATA!
The purpose of this survey is to help data controllers identify their obligations under the Personal Data Protection Act (PDPA) and to provide a better understanding of the PDPA. In addition, the survey will help the experts from AZLP and the experts engaged within the twinning project to get more detailed knowledge about the needs of data controllers in North Macedonia. Based on the findings of the survey, the twinning project partners will develop guidelines and accountability tools tailored to the needs of data controllers in North Macedonia, thus supporting them in showing accountability and achieving compliance with the law.
Completing this survey will take about 25 minutes of your time, allowing you to better understand your obligations and us to better understand your needs. The deadline for completing the survey is September 17, 2021.
The survey can be completed by all persons who are employed and engaged by data controllers.
The survey is conducted anonymously, and the results will be based on aggregated data.
IMPORTANT NOTE! If you process personal data within the scope of your activity, then ZZLP also applies to you. It is important to know that the Law on the Protection of Personal Data also applies to the personal data of employees. If you think you are not processing personal data, think again! Do you have video surveillance in your premises? As part of your business, do you send promotional materials to customers and post photos on social media? Do you keep your students’ test scores? Do you copy your guests’ IDs? Do you collect personal data through the so-called cookies on your official websites? Remember, even when you only keep employee or customer personal data in a folder, this is considered processing of personal data.
The protection of personal data is a fundamental right guaranteed in Article 18 of the Constitution of North Macedonia and guarantees protection against violation of personal integrity as a result of recording personal information through automated and non-automated data processing. In the European Union, the right to protection of personal data is a fundamental right and it is protected by the General Data Protection Regulation. Namely, The General Data Protection Regulation (GDPR) is one of the strongest and most comprehensive laws governing the collection and use of personal data by governments and the private sector. It gives citizens more control over their personal data and strengthens existing rights, but also provides new rights. At the same time, the regulation ensures the free movement of personal data within the EU and thus boosts the economy by facilitating cross-border data exchange.
In order to ensure the same level of personal data protection for the citizens of North Macedonia and to keep up with the European legislation, in February 2020 a new Law on the Protection of Personal Data was adopted (“Official Gazette of the Republic of North Macedonia” no. 42/20) which transposes the EU Regulation 2016/679 on the protection of personal data (GDPR).
On August 24, 2021, the full application of the Law on Personal Data Protection will enter into force. Are you ready? This survey will help you determine and understand your obligations under the Personal Data Protection Law (PDP).
